Privacy Policy

This Privacy Policy explains how AI Kiss Team ("we," "our," or "us") collects, uses, shares and protects your information when you use the AI Kiss website at aikiss.app, the AI Kiss mobile apps and related services (the "Service"). We are responsible for your personal data as its controller.

1. Information We Collect

1.1 Information You Provide

• Photos and prompts: the images you upload and any text you write to describe a video
• Generated videos: the videos the Service creates for you
• Account information: your email address and name if you sign in with Google, Apple or an email link, or if you give us your email to receive reminders
• Purchase information: what you bought, when, the amount, your country and your credit balance. Card details are entered directly with Stripe (or Apple or Google in the apps); we only receive limited details such as the card brand, its last four digits and the country it was issued in
• Support communications: messages you send us

1.2 Automatically Collected Information

• Device and log data: IP address, browser and device type, operating system, language and approximate location derived from the IP address
• Usage data: pages viewed and actions taken in the Service, such as starting a video or opening the payment screen, linked to a random identifier
• Cookies and similar technologies: see section 12

We do not create or store facial recognition templates or other biometric identifiers from your photos.

2. How We Use Your Information and Why

• To provide the Service (performing our contract with you): generating and storing your videos, keeping your credit balance, processing purchases and subscriptions, sending receipts and answering support requests
• To keep the Service safe (our legitimate interests and legal obligations): screening uploads for nudity and other prohibited content, preventing fraud and payment abuse, handling disputes and enforcing our Terms
• To improve the Service (our legitimate interests): understanding which features and pages work, fixing errors and measuring our advertising
• To send reminder and offer emails (your consent, or our legitimate interests where the law allows): every such email has an unsubscribe link
• To comply with the law (legal obligation): for example keeping payment records for tax purposes

3. Your Photos and Videos

• On the website your photos are resized and combined into one frame on your own device, and only that frame is uploaded. It is stored in our cloud storage and sent to our AI processing provider, which screens it for prohibited content and generates the video
• Generated videos are stored in your account so you can watch, download and retry them
• A video is only visible to others if you create a share link for it; you can revoke a share link at any time
• Only upload photos of people who agreed to it. Anyone pictured in a video can ask us to delete it by emailing privacy@aikiss.app

4. Who We Share Information With

We do not sell, trade, or rent your personal information. We share it only with service providers that process it on our behalf and under our instructions, to run the Service:

• Legal requirements: when required by law, court order or a lawful request from authorities, including reporting child sexual abuse material
• Protection: to protect the rights, safety and property of our users, the public or us, including fraud prevention and payment disputes
• Business transfers: in connection with a merger, acquisition, or sale of assets, under this same Privacy Policy
• With your consent: for example when you share a video

5. Data Retention

• Photos and videos: kept while your account exists, so you can come back to them, and deleted within 30 days of your request or of your account being closed
• Account data and credit balance: until you ask us to delete your account
• Purchase records: for as long as tax and accounting laws require, even after your account is deleted
• Usage and log data: only as long as needed to run, secure and improve the Service, then deleted or anonymised
• Support communications: for a reasonable period to handle your request and any follow-up

6. Data Security

Data is encrypted in transit (HTTPS) and at rest on our cloud providers, access to it is restricted to the people who need it to run the Service, and payments are handled by PCI DSS certified payment processors. No system is perfectly secure, but we work to protect your information and will notify you and the authorities of a breach where the law requires.

7. Your Privacy Rights

Depending on where you live, you have the right to:

• Access the personal information we hold about you and get a copy of it
• Correct or update it
• Delete it, including your photos and videos
• Object to or restrict how we process it
• Data portability
• Withdraw consent at any time, such as unsubscribing from emails or changing your cookie choice

To use any of these rights, email privacy@aikiss.app from the email on your account or receipt (or include the invite link from Settings if you never signed in), so we can find the right account. We respond within 30 days and do not charge for it. If you are in the EEA or the UK, you can also complain to your local data protection authority.

California residents: we do not sell your personal information. We use Google Analytics and Google Ads to measure visits and ad performance; you can opt out by declining cookies where offered, using your browser's Global Privacy Control signal, or emailing privacy@aikiss.app. We will not treat you differently for using your privacy rights.

8. Children's Privacy

AI Kiss is only for adults aged 18 and over. We do not knowingly collect personal information from anyone under 18, and photos of minors are not allowed in the Service. If we learn that we hold information from or about a minor, we delete it. If you believe a minor is using AI Kiss or appears in content on it, email privacy@aikiss.app.

9. International Data Transfers

Our providers process data in the United States and other countries that may not have the same data protection laws as yours. Where the law requires, these transfers are protected by safeguards such as the European Commission's Standard Contractual Clauses and the UK Addendum, or the provider's certification under the EU-U.S. Data Privacy Framework.

10. Third-Party Services

The Service links to other websites and services, such as social networks where you share videos. This Privacy Policy does not apply to them; please read their privacy policies.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the new version on this page and update the "Last Updated" date, and tell you in the app or by email about material changes before they take effect.

12. Cookies and Consent

We use Google Analytics and Google Ads to measure visits to this site and to see which ads lead to a purchase. In the EEA, the UK and Switzerland those tags only store or read cookies after you accept them in the cookie banner; until then they run in a consent-denied mode that sends no advertising identifiers. You can change your answer at any time by clearing this site's data in your browser, which brings the banner back on your next visit. Our own usage log is cookieless: it counts page views and clicks against a random id kept in your browser, and it is never shared with an advertising network. Sign-in and payments also use storage that is strictly necessary for them to work.
