Terms of Service

Welcome to AI Kiss! These Terms of Service ("Terms") govern your use of the AI Kiss website at aikiss.app, the AI Kiss mobile apps and the related services (together, the "Service"), operated by AI Kiss Team ("we," "our," or "us").

1. Acceptance of Terms

By accessing, downloading, installing, or using AI Kiss, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service. These Terms are a legally binding agreement between you and AI Kiss Team.

2. Eligibility: Adults Only

You must be at least 18 years old, and of legal age to enter a contract where you live, to use AI Kiss or to buy credits. By using the Service you confirm that you are. We do not knowingly allow anyone under 18 to use the Service, and we close any account we learn belongs to a minor.

3. Description of Service

AI Kiss is an artificial intelligence video tool. You upload one or two photos, choose a style (such as a kiss, hug or slow dance) or describe one in your own words, and the Service generates a short video from them. Videos are created by AI models: they are synthetic, they may not look exactly like the people in the photos, and results vary. You can download and share the videos you create.

4. Consent and Acceptable Use

4.1 Consent of Everyone Pictured

Only upload photos of yourself, or of people who have given you their permission to be used in an AI video. By uploading a photo you confirm that you have that permission and every other right needed to use it. Do not upload photos of public figures, celebrities or strangers without their consent.

4.2 Prohibited Content

You may not upload, create, request or share content that:

• Shows or involves anyone under 18, in any way
• Contains nudity, explicit sexual content, or pornographic material
• Is used to harass, bully, shame, threaten, extort or impersonate anyone
• Is presented as real footage in order to deceive others, including misleading "deepfakes" of real people
• Violates any person's privacy, publicity, or other rights
• Contains hate speech, harassment, or discriminatory content
• Promotes violence, terrorism, or illegal activities
• Infringes on copyrights, trademarks, or other intellectual property rights
• Violates any applicable laws or regulations

4.3 How We Enforce These Rules

Every uploaded photo is screened automatically before a video is generated, and nude or explicit images are rejected without using any credits. Prompts written in your own words are checked against a list of blocked terms. Automated checks are not perfect, so you remain responsible for what you upload. We may refuse any request, remove any content, and suspend or close accounts that break these rules. To report content that breaks them, email legal@aikiss.app.

4.4 Prohibited Activities

You may not:

• Resell the Service or use it for commercial purposes without our written consent
• Reverse engineer, decompile, or disassemble any part of the Service
• Attempt to get around our safety checks, usage limits or payment systems
• Attempt to gain unauthorized access to our systems or networks
• Upload malicious code, viruses, or other harmful software
• Create fake accounts, use stolen payment details, or impersonate others
• Spam, flood, or overload our servers
• Collect or harvest user information without consent

5. Accounts

You can start using AI Kiss without signing up; the Service then keeps your credits and videos on the device and browser you used. You can save your account by signing in with Google, Apple or an email link, which lets you get back to your credits and videos on another device and lets us send you receipts. You are responsible for activity on your account and for keeping access to it secure. Tell us at support@aikiss.app if you think someone else has used it.

6. Prices, Payments and Taxes

• Prices are shown on the pricing page and on the payment screen before you pay, in the currency you will be charged. Prices may differ between countries and may change, but the price you confirm is the price you pay.
• Payments on the website are processed by Stripe. We never see or store your full card number. Purchases made inside our iOS or Android app are processed by Apple or Google under their terms.
• Prices include any sales tax or VAT we are required to collect, unless the payment screen says otherwise. Your bank may charge its own fees, such as for currency conversion.
• Charges appear on your card statement as AIKISSAPP.COM/CANCEL.

7. Credits

• Videos are paid for with credits. The number of credits a video uses depends on its length and is shown before you generate it.
• Credits never expire and stay on your account if you cancel a subscription.
• If a video fails to generate, the credits it used are returned to your balance automatically. If a photo is rejected by our safety check, no credits are used.
• Credits are a prepaid licence to use the Service. They have no cash value, cannot be exchanged for money except as a refund of unused credits under section 9, and cannot be sold or transferred to another account.
• Free or promotional credits (for example from a promo code or a referral) may come with their own conditions and can be withdrawn if obtained by abuse.

8. Subscriptions (Value Packages)

Some credit purchases are offered as a subscription we call a value package (weekly, monthly or yearly). By starting one you authorise us to charge your payment method at the start of each billing period until you cancel.

• A value package renews automatically at the end of each billing period, at the price shown when you subscribed, until you cancel it.
• Credits are added to your balance at each successful payment, in the amount shown on the plan you chose.
• Introductory offers: if you start with a discounted first period (for example $0.99 for the first week), the payment screen and your receipt show the introductory price, how long it lasts and the regular price it renews at. Unless you cancel before the introductory period ends, the subscription renews at that regular price. Introductory offers are limited to one per person and payment card.
• How to cancel: at any time at aikiss.app/cancel (it works without signing in, using the email on your receipt), from Settings in the app, or by emailing support@aikiss.app. Cancellation takes effect at the end of the period you have already paid for, and you are not charged again. Subscriptions bought through Apple or Google are cancelled in your App Store or Google Play subscription settings.
• Prices may change. We will tell you before a changed price applies to a renewal, and you may cancel before it takes effect.
• If a renewal payment fails, the subscription may be suspended or cancelled and no further credits are added.

9. Refunds and Cancellation

• Unused credits: email us and we refund the credits you have not used from your purchase, and remove them from your balance.
• Failed videos: if a video fails to generate, its credits are returned to your balance automatically, so they count as unused again.
• Subscriptions: if a renewal went through that you did not mean to keep, email us within 7 days. We refund the unused credits from that renewal and cancel the subscription. Credits already used from it are not refunded, and we do not refund a partial billing period otherwise.
• Billing mistakes: duplicate charges and charges taken after a cancellation went through are refunded in full.
• EU, EEA and UK customers: credits are digital content supplied immediately. By completing a purchase you ask us to supply it straight away and acknowledge that you lose your 14-day right of withdrawal for credits you have used. Unused credits remain refundable as above.

To ask for a refund, email support@aikiss.app with the email address on your receipt (or the last four digits of your card) and the date of the charge. We answer within 48 hours, and approved refunds go back to the original payment method; banks usually take 5 to 10 business days to show them. App Store and Google Play purchases are refunded by Apple or Google through their own refund process.

Please contact us before disputing a charge with your bank: we can usually resolve it faster. If a charge is disputed, we may suspend the account until the dispute is resolved. None of this limits any rights you have under the consumer laws of the country you live in.

10. Content and Intellectual Property Rights

10.1 Your Content

You keep ownership of the photos you upload and the text you write ("Your Content"). You give us a limited, worldwide, non-exclusive licence to store and process Your Content only to run the Service for you: to generate your videos, to show them to you, to let you download and share them, and to keep the Service safe. We do not use Your Content to train AI models, and we do not use it in our marketing without your separate permission.

10.2 Generated Videos

• You may use the videos you generate for personal, non-commercial purposes
• You may share them on social media, provided everyone shown agreed to it
• Do not present a generated video as real footage, and do not remove any notice that it was made with AI
• You must comply with all applicable laws when sharing content

10.3 Our Intellectual Property

AI Kiss and all related technology, software, designs and branding belong to us or our licensors. You may not copy, modify, or distribute them without written permission.

11. Privacy

How we collect, use, store and delete your information, including the photos you upload, is described in our Privacy Policy, which forms part of these Terms.

12. Service Availability and Changes

We aim to keep AI Kiss available at all times but cannot guarantee uninterrupted access. The Service may be unavailable during maintenance, technical problems, outages at our providers, or events beyond our control. We may change, add or remove styles and features. If we ever shut the Service down, we will give at least 30 days' notice on the website and refund unused credits bought in the 12 months before.

13. Disclaimers and Limitation of Liability

13.1 Service Disclaimers

Apart from the commitments in these Terms, the Service is provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise that every video will look the way you expect.

13.2 Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve months before the claim, or $100, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless AI Kiss Team from claims, losses and costs (including reasonable legal fees) arising from Your Content, your breach of these Terms, or your violation of any law or of anyone else's rights, including the rights of people shown in the photos you upload.

15. Termination

15.1 Termination by You

You may stop using the Service at any time. To have your account and data deleted, email privacy@aikiss.app. Cancel any subscription first (section 8) so you are not charged again.

15.2 Termination by Us

We may suspend or close your account if you break these Terms (in particular section 4), if we suspect fraud or illegal activity, or if we must for legal or security reasons. If we close an account for any other reason, we refund its unused paid credits.

15.3 Effect of Termination

When your account is closed, your right to use the Service ends and any subscription stops renewing. We delete your content as described in the Privacy Policy, except where we must keep information by law.

16. Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts.

16.2 Dispute Resolution Process

Before pursuing formal legal action, please contact us directly. Most concerns can be resolved quickly.

17. Changes to These Terms

We may update these Terms to reflect changes in the Service, the law or our business. We will post the updated Terms here and update the "Last Updated" date, and for material changes we will also tell you in the app or by email before they take effect. If you keep using the Service after that, the updated Terms apply. Changes never apply retroactively to purchases you have already made.

18. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, it will be limited to the minimum extent necessary and the rest of the Terms remain in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and AI Kiss Team regarding the Service.

19. Additional Terms for Mobile Apps

If you use AI Kiss through an app downloaded from the Apple App Store or Google Play, you also agree that:

• These Terms are between you and AI Kiss Team, not the app store
• The app store is not responsible for the Service or its content
• You must comply with applicable app store terms and policies
• The app store and its subsidiaries are third-party beneficiaries of these Terms
